Constitution of Spain

Constitutions and Founding Charters

The Spanish Constitution is the supreme law of the Kingdom of Spain, approved by referendum on 6 December 1978 with 91.81 percent support, sanctioned by King Juan Carlos I on 27 December 1978 and in force from 29 December 1978. It emerged from a constituent assembly convened after the 1977 general election, drafted by a seven-member cross-party panel later called the fathers of the Constitution, and closed Spain's transition to democracy following the death of Francisco Franco. The document runs to 169 articles across ten parts plus a preamble, establishing Spain as a parliamentary monarchy with a decentralized territorial structure and a catalogue of fundamental rights.
